Judge says no to injunction of Ohio Smoking Ban

The Cincinnati Enquirer has an update on the fight against the Ohio nanny state.

A Hamilton County judge snuffed out the last opposition to Ohio’s indoor smoking ban today, clearing the way for the law to take effect Thursday.

Common Pleas Judge Fred Nelson refused to block enforcement of the law after concluding Ohioans do not have a constitutional right to smoke or to own businesses that permit smoking.

“There is no fundamental right … to smoke in public,” Nelson wrote in his decision. “This court declines to fabricate such a right.”

They are going to continue challenging this law, but this was definitely a blow against us.

    That is our great state for you. Ohioans like to shoot ourselves in the foot and send everyone to KY, IN and the other border states. We vote down casinos and vote in no smoking laws. So we drive 20 minutes to Indiana to the boats and 15 minutes to Kentucky to smoke, drink and have a night out. Cincinnati for sure has nothing to keep us here as it is and this smoking ban is a nice finish.

    There are a few bars down here that get a decent crowd at night, but I wonder how long that will last with the smoking ban starting today. There was a couple haunts I’d stop into down here after work, but it is just as easy to go across the river on my way home.

    The only purpose for which power can be rightfully exercised over ANY member of a civilized community against his will is to prevent harm to others. For “HIS OWN GOOD, EITHER PHYSICAL OR MORAL, IS NOT SUFFICIENT WARRANT!

    Anyone thinking “i don’t smoke” therefore ignore the “SMOKING BAN-WAGON” your ADULT choices are about to be taken away soon too-If ANY Government official were to truely believe smoking is a “safety concern”-quit collecting all the cigarette taxes & take your scientific medical proof to make ALL tobacco products ILLEGAL-Until YOU give up your millions in cigarette taxes-KEEP YOUR HANDS OUT OF MY REGISTER! My ADULT customers ARE capable of reading a smoking sign posted & they ARE capable of CHOOSING to enter or not. Like you-ENOUGH!
