Part of what bothers me is that the claim for the ban is to “keep employees safe”. Employees have choices. They may choose to be smokers, or they may choose to be non-smokers. I am a manager of a formerly smoking restaurant. Last time I checked, I did not go banging on peoples’ doors forcing them to work for me, they came to me asking for a job. They chose to work in an atmosphere that included smoking.
Every business should be able to make this decision for themselves. Joe Non-Smoker would more than likely still have the option of a smoke free environment, he would just have to limit his options. That would be no different than those Ohioans in wheelchairs who can still only patronize certain facilities due to “grandfathering” certain businesses in the Americans with Disabilities Act.

What about federal employees working in local offices, such as the U.S.Postal Service? They are exempt from this law.
